Welcome to ALSO.

These Terms of Service govern your access to and use of the website, online store, products, content, features, tools, and services operated by Also Nutrition LLC ("ALSO," "we," "us," or "our"), collectively referred to as the "Services."

Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer our products and Services to you.

By visiting, accessing, or using the Services, or by purchasing a product from us, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

Section 1: Eligibility and Accounts

By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence.

You may be asked to provide information such as your name, email address, billing information, payment information, and shipping address in order to use certain Services or make a purchase.

You agree that the information you provide is accurate, current, and complete.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity that occurs through your account.

Product colors, packaging, appearance, and other visual details may appear differently depending on your screen, device, lighting, or display settings.

Product packaging and design may also be updated from time to time.

We reserve the right to modify product descriptions, formulations, packaging, pricing, availability, or other product details where permitted by law.

We may discontinue a product or limit product quantities available to any customer, geographic area, or jurisdiction.

Section 3: Health and Wellness Information

Content provided through the Services is intended for general informational and educational purposes only.

It is not intended to provide medical advice, diagnosis, or treatment and should not be used as a substitute for advice from a qualified healthcare professional.

ALSO products are not intended to diagnose, treat, cure, or prevent any disease.

Individual experiences with dietary fiber and other dietary products may vary.

If you are pregnant or nursing, have a medical condition, take prescription or over-the-counter medications, use a GLP-1 medication, or have questions about whether an ALSO product is appropriate for you, consult a qualified healthcare professional.

Nothing on the Services should be interpreted as a guarantee that you will experience a particular health or wellness outcome.

Section 4: Orders

When you place an order, you are making an offer to purchase products from Also Nutrition LLC.

We reserve the right to accept, reject, limit, or cancel an order where permitted by law.

Your order is not considered accepted until we confirm the order and successfully process payment.

Please review your order carefully before submitting it. We may be unable to cancel or change an order once fulfillment has begun.

If we cancel or materially change an order, we will attempt to notify you using the email address, phone number, billing address, or other contact information provided with the order.

Purchases, returns, refunds, and our satisfaction guarantee are governed by our Refund Policy, available on this website.

Products purchased through our consumer website are intended for personal or household use unless otherwise agreed by us in writing.

Section 5: Prices and Billing

Prices, discounts, promotional offers, and product availability may change without notice.

The price charged for a product will be the price disclosed at the time you place your order, subject to any applicable promotion.

Unless expressly stated otherwise, prices may not include applicable taxes, duties, customs fees, or other government charges.

We may periodically offer promotional pricing or discounts that are subject to separate terms. If the terms of a particular promotion conflict with these Terms, the promotion-specific terms will control for that promotion.

You agree to provide current, complete, and accurate billing, payment, and account information.

You represent that you are authorized to use the payment method provided and authorize us and our payment processors to charge amounts associated with your purchases.

Section 6: Subscriptions and Recurring Billing

Certain ALSO products are available through recurring subscription plans.

When you purchase a subscription, you authorize Also Nutrition LLC and its payment providers to automatically charge your selected payment method at the price and frequency disclosed before you complete your purchase.

The subscription price, initial promotional price if applicable, renewal price, shipment frequency, and other material subscription terms will be disclosed at checkout.

For example, a subscription may include an introductory first-order price that differs from the recurring renewal price. Any such pricing will be clearly disclosed before purchase.

Your subscription will continue and automatically renew until you cancel it or otherwise modify it in accordance with the options available to you.

You may pause, cancel, or modify your subscription before the next order is processed through the available subscription-management tools or by contacting us at hello@alsonutrition.com.

Canceling a subscription prevents future renewal orders. Cancellation does not automatically cancel or refund an order that has already been processed.

Once an order has entered processing or fulfillment, we may be unable to stop or modify it.

Subscription orders and refunds are subject to our Refund Policy.

We may change future subscription pricing, products, frequencies, or other subscription terms where permitted by law. Where legally required, we will provide advance notice before a material change applies to future recurring charges.

You are responsible for keeping your payment and shipping information current.

Section 7: Shipping and Delivery

Delivery dates and shipping times are estimates and are not guaranteed.

Delays may occur because of shipping carriers, weather, customs, supply disruptions, incorrect delivery information, or circumstances outside our reasonable control.

Please provide a complete and accurate shipping address when placing your order.

If your order is damaged, incorrect, incomplete, lost, or otherwise has a delivery issue, contact us at hello@alsonutrition.com and we will work with you to evaluate and resolve the issue.

Section 8: Returns, Refunds, and Guarantee

Returns, refunds, and the ALSO satisfaction guarantee are governed by our Refund Policy.

Our current first-purchase guarantee, when applicable, is subject to the eligibility requirements and limitations stated in that policy.

Canceling a subscription does not automatically create a right to a refund for an order that has already been processed.

Section 9: Intellectual Property

The Services, including our trademarks, logos, branding, product names, designs, text, graphics, photographs, videos, audio, website design, and other content, are owned by or licensed to Also Nutrition LLC and are protected by applicable intellectual-property laws.

You may use the Services for your personal, non-commercial use.

Unless expressly permitted by us in writing, you may not reproduce, copy, distribute, modify, publish, display, transmit, create derivative works from, sell, license, or commercially exploit any portion of the Services.

The names ALSO, Also Nutrition, our logos, product names, packaging, designs, slogans, and related brand elements are trademarks or other intellectual property of Also Nutrition LLC or its licensors.

Nothing in these Terms grants you a license to use our intellectual property except as expressly stated.

Section 10: Optional and Third-Party Tools

We may provide access to tools, software, integrations, or services provided by third parties.

We may not monitor or control these third-party tools.

Unless otherwise expressly stated, access to third-party tools is provided on an "as is" and "as available" basis.

Your use of third-party services may be subject to separate terms and privacy policies maintained by those third parties.

We may add, change, or discontinue tools or functionality made available through the Services.

Section 11: Third-Party Links

The Services may include links to websites, services, applications, or other resources operated by third parties.

We do not control and are not responsible for the content, security, accuracy, availability, products, practices, or privacy policies of third-party websites.

Your use of third-party websites and services is at your own discretion and may be governed by separate terms.

Questions or complaints about third-party products or services should generally be directed to the applicable third party.

Section 12: Relationship With Shopify

ALSO's online store is powered by Shopify.

Any sale or purchase made through our store is a transaction directly between you and Also Nutrition LLC.

Shopify provides ecommerce infrastructure and related services but is not the seller of ALSO products.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, injury, loss, or damages arising from products purchased directly from Also Nutrition LLC.

Section 13: Privacy

Our collection, use, processing, and disclosure of personal information is governed by our Privacy Policy, available on this website.

Because Shopify hosts portions of the Services, Shopify may independently collect and process certain personal information relating to your use of the store.

Shopify's handling of such information may also be governed by Shopify's own privacy policies.

By using the Services, you acknowledge that information may be processed by Shopify and other service providers as described in our Privacy Policy.

Section 14: Feedback, Reviews, and User Content

If you submit reviews, photographs, comments, suggestions, ideas, feedback, testimonials, or other content to us ("Feedback"), you grant Also Nutrition LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, display, distribute, and otherwise use that Feedback in connection with operating, improving, or promoting our business and Services.

You represent that you own or otherwise have the rights necessary to provide the Feedback and permit us to use it.

You must disclose any compensation, free products, discounts, or other incentives received in connection with a review or endorsement where disclosure is required by law.

You may not submit content that infringes another person's intellectual-property, privacy, publicity, or other rights or that is unlawful, defamatory, abusive, fraudulent, obscene, or malicious.

We may remove or decline to publish Feedback at our discretion where permitted by law.

From time to time, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, availability, shipping, or other matters.

We reserve the right to correct errors, update information, or cancel orders affected by inaccurate information where permitted by law.

Nothing in this section limits rights you may have under applicable consumer-protection laws.

Automated software, bots, agents, or services that access or interact with the Services must comply with applicable technical restrictions, security measures, robots directives, and other access controls implemented by us or our service providers.

Automated tools may not disguise their automated nature, circumvent CAPTCHA or similar security measures, bypass technical limitations, or access areas of the Services that we have restricted.

We reserve the right to limit or block automated access where reasonably necessary to protect the Services, customers, or our business.

We may suspend or terminate your access to all or part of the Services if you violate these Terms, misuse the Services, engage in fraud or unlawful activity, or where termination is otherwise permitted by law.

You remain responsible for amounts properly incurred before termination.

Sections that by their nature should survive termination, including intellectual-property provisions, disclaimers, limitations of liability, indemnification, and dispute-related terms, will continue to apply.

Section 19: Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not warrant that the Services will always be uninterrupted, secure, timely, accurate, or error-free.

Information made available through the Services is provided for general informational purposes.

Except for express promises we specifically make in connection with a product, our Refund Policy, or our satisfaction guarantee, we disclaim warranties to the fullest extent permitted by applicable law, including implied warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.

Some jurisdictions do not permit certain warranty disclaimers, so portions of this section may not apply to you.

Section 20: Limitation of Liability

To the fullest extent permitted by applicable law, Also Nutrition LLC and its affiliates, officers, directors, employees, contractors, agents, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of the Services or products purchased through the Services.

This may include, where legally permitted, lost profits, lost revenue, lost data, replacement costs, or similar losses.

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be prohibited by applicable law.

Some jurisdictions do not permit certain limitations of liability, so some portions of this section may not apply to you.

Section 21: Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Also Nutrition LLC, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable legal fees arising from:

1. your material breach of these Terms;
2. your violation of applicable law;
3. your violation of another person's rights; or
4. your misuse of the Services.

We will provide reasonable notice of a claim for which indemnification is sought where required by law.

Section 22: Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The remaining provisions will continue in full force and effect.

Section 23: Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with policies and additional terms referenced on the Services, constitute the agreement between you and Also Nutrition LLC regarding your use of the Services, except where separate written agreements apply.

Section 24: Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or other business transaction, or as otherwise permitted by law.

Section 25: Governing Law

These Terms and any separate agreements through which we provide the Services will be governed by applicable federal law and the laws of the state in which Also Nutrition LLC maintains its principal place of business, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.

Any dispute will be subject to the jurisdiction and venue of courts having proper jurisdiction under applicable law.

Section 26: Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, business practices, legal requirements, or other operational considerations.

The current version will be posted on this website together with the date it was last updated.

Where required by law, we will provide notice of material changes.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
